Yesterday Tracy Hernandez, CEO of BizFed, Stuart Waldman, CEO of the Valley Industry and Commerce Association (VICA) and Maria Salinas, CEO of the Los Angeles Chamber of Commerce
arranged calls with the Editorial Boards of both the LA Times and the Southern CA News Group to inform them of LA City Councils extreme overreach regarding the "Right of Recall" ordinance.
We made it clear that the ordinance is bad for business and workers as a whole, and in uncertain times the City Council should be supporting businesses and not adding burdensome regulations.
We are pleased to announce they agreed. Both the LA Times and the SCNG OPPOSE the "Right of Recall" ordinance.

At their Council meeting, for the first time virtually, TODAY at 11am, the LA City Council will take up items that seek to take away your private employer hire/fire rights.
All 15 Council members must hear from employers ASAP!
Los Angeles City Council is trying to take advantage of the coronavirus pandemic and
pull a major labor power-grab by dictating the hiring practices of businesses "Right of Recall" and implementing a citywide workers “Right-of-Retention" policy.
The two ordinances are part of an "emergency" COVID-19 package that the Council first voted on March 17th. They are back as items #2 and #4 TODAY at 11am.
Read the ordinances here.
How does it impact you?
The "Right of Recall" ordinance:
- Applies to any person or entity who employs a worker who works in the City of Los Angeles and who earned gross receipts in 2019 exceeding $5,000,000.
- Targeted to impact workers who were laid-off retroactively at anytime on or after March 4, 2020 with a presumption that any termination following this date was for non-disciplinary reasons.
- Requires that an employer shall offer in writing, to the last known address of every laid off worker, any position which is or becomes available for which the laid off worker is qualified. The worker has 10 days to reply.
- If two workers qualify for the same position, the person with seniority shall be offered the position.
- Exempts businesses with a Collective Bargaining Agreement.
- Remains in effect until March 4, 2022. The City Council can vote to extend it.
The "right of retention" ordinance:
- When a business is sold or purchased by another company, this requires the new owners to retain current employees for at least 90 days.
- At the end of the 90 days, the successor must do an evaluation of each employee and if their work is satisfactory, consider them for employment. These records must be kept for three years.
- Exemptions for businesses with a Collective Bargaining Agreement.
