ACTION ALERT – City of Los Angeles to review Recall and Retention ordinances TOMORROW

The City of Los Angeles TOMORROW at 10am will again review items that seek to take away your private employer hiring rights through their "right of recall" and "worker retention" ordinance. Details below. The Los Angeles City Council will NOT be voting on an actual ordinance. Instead they will be reviewing the amendments that were presented at the March 27th emergency meeting and direct the city attorney's office to update the draft. This includes a discussion on making this ordinance PERMANENT, instead of a crisis-only "solution." The city MUST hear from the business community. Several city council members are trying to take advantage of the coronavirus pandemic and pull a major labor power-grab by dictating the hiring practices of businesses. All 15 Council members must hear from employers ASAP! TAKE ACTION NOW Read the Chief Legislative Analysts Report here. How does it impact you? The "Right of Recall" ordinance w/ suggested amendments:
  • Requires employers to rehire laid-off employees by seniority.
  • Applies to businesses with 50 employees or more in the "hospitality" industry (not clearly defined).
  • Exempts restaurants.
  • Targeted to impact workers who were laid-off retroactively at anytime on or after March 4, 2020.
  • Presumes that any termination following March 4, 2020 was for non-disciplinary reasons and incumbent upon the employer to prove that a termination was for disciplinary reasons in court.
  • Requires that an employer give former employees 48 hours to respond to a rehire offer. This was originally a 10 day written notice.
  • Exempts businesses with a Collective Bargaining Agreement.
  • The City Council will discuss making this a permanent ordinance.
The "right of retention" ordinance: 
  • When a business is sold or purchased by another company, this requires the new owners to retain current employees for at least 90 days.
  • If layoffs are needed during the 90 days, the business must lay off in order of seniority (seniority being the last to be laid off).
  • Also only applies to businesses with 50 or more employees in the hospitality industry.
  • Exemptions for businesses with a Collective Bargaining Agreement.
