Why does BizFed oppose SB 1387?
Because it would remove regional authority from local elected officials who are accountable to their local constituents, bypass the democratic process, and weaken the South Coast Air Quality Management District’s (SCAQMD) decision-making ability.
If this bill passes, then it would set a chilling precedent for pre-emption of local control on other boards and commissions throughout California. Specifically, SB 1387 would:
- Add three more state-appointed representatives to SCAQMD’s Governing Board, effectively giving Sacramento control of over 40 percent of the Board.
- Give the California Air Resources Board (CARB) the power to overrule, revise, and replace the regional market-based incentive programs without SCAQMD involvement, essentially allowing CARB to take over the regional board’s rulemaking authority.
