ACTION ALERT: Stop duplicative permits that could cost your business millions

This is an urgent, red-alert call to action. We need all BizFed members to speak up and protect hospitals, universities, churches, courts, malls, warehouses, business parks, marine ports, and numerous other businesses and facilities from duplicative compliance costs that could easily add up to tens of millions of dollars. AB 2106 (Rivas) is on the Senate floor and could come up for a vote any day now. The Legislature has until August 31st to send bills to Governor Newsom's desk for his signature.

We've been mobilizing to halt this bill for months now. We featured it in our three-item July Energy Newsletter as the "item to act on" because of its broad impact.

The proposal to mandate stormwater discharge permits for all "commercial, industrial, and institutional" facilities could open up YOUR business to expensive and potentially onerous citizen lawsuits. Commercial and institutional facilities are already subject to local stormwater regulation! Worst of all, AB 2106 has no guaranteed environmental benefits and may not even be feasible to enforce. In Washington, where similar stormwater mandates were imposed, regulators quickly discovered that none of the available compliance technologies could meet permitting requirements.

The Department of Finance even took a stance opposing AB 2106, noting that it would result in significant fee increases that "create General Fund cost pressures to offset fee increases."


The clock is ticking. The Senate floor vote on AB 2106 could happen as early as today or tomorrow. Raise your voice and tell legislators we won't let overzealous regulators kill economy-stimulating jobs.
